Today, litigation is a major part of the litigation in the judiciary. The importance of the family institution and its profound impact on society and the requirements governing family litigation make clear the need for specific principles for such litigation. Obviously, the acceptance of the specific principles of family litigation will also require the adoption of the specific rules of procedure in this case. Because the complex rules of civil procedure cannot meet the requirements of family litigation, such as speed, ease, and accuracy. The new Family Protection Act, which is aimed at resolving existing problems and removing legal vacancies governing family law, has made some changes to the rules of procedure of the lawsuit and, in some cases, to some innovative aspects. However, attention to some of the substantive issues has partially offset the law. This article, while explaining the principles governing family law, examines the law and to some extent the laws of other legal systems, including England and France, in the light of these principles. This study could illuminate the success of the new Family Protection Act in this regard.
